Nocturne Fiction ("we," "us," or "our") is operated by Nocturne AI LLC. This Privacy Policy explains how we collect, use, and protect your information when you use nocturnefiction.com (the "Service"). By using the Service, you agree to the terms of this policy.

This Service is intended for adults 18 years of age and older. We do not knowingly collect information from minors.

1. Information We Collect

Account Information

When you create an account, we collect your email address and a hashed password. We do not store your plain-text password.

Payment Information

Payments are processed by Stripe. We do not store your credit card number, expiration date, or CVV. Stripe provides us with a payment token and transaction record only. You can review Stripe's privacy policy at stripe.com/privacy.

Conversation Data

Your conversations with characters are stored to enable persistent memory and relationship progression — that's core to the experience. Conversation data is associated with your account and is not shared with third parties.

Usage Data

We collect standard server logs including IP address, browser type, pages visited, and timestamps. This data is used for security, debugging, and improving the Service.

  • To create and manage your account
  • To provide, personalize, and improve the Service
  • To process payments and manage subscriptions
  • To maintain character memory and relationship progression across sessions
  • To send transactional emails (account confirmation, receipts, password resets)
  • To detect and prevent fraud or abuse
  • To comply with legal obligations

We do not sell your personal data to third parties. We do not use your conversation data to train AI models without your explicit consent.

3. Adult Content & Age Verification

The After Dark tier contains explicit adult content. Access requires age verification. By enabling After Dark content, you confirm that you are at least 18 years of age. Age verification data is handled by Stripe Identity and is subject to Stripe's privacy practices.

4. Data Sharing

We share data only with:

  • Stripe — payment processing and age verification
  • Anthropic / OpenRouter — AI model providers that process conversation messages to generate character responses. Messages are sent to these providers to power the experience.
  • Vercel — hosting and infrastructure provider
  • Neon — database infrastructure provider

We may disclose information if required by law, court order, or to protect the rights and safety of users or the public.

5. Data Retention

We retain your account and conversation data for as long as your account is active. If you delete your account, we will delete your personal data within 30 days, except where retention is required by law (e.g., financial records).

6. Your Rights

Depending on your location, you may have the right to:

  • Access the personal data we hold about you
  • Request correction of inaccurate data
  • Request deletion of your account and data
  • Object to or restrict certain processing
  • Export your data in a portable format
